法院執(zhí)法考評典型經驗材料

嚴管理狠抓法院制度建設

近年來,我院從自身工作特點出發(fā),圍繞審判這一中心工作,針對過去法院內部管理方面存在的漏洞和問題,從容易發(fā)生徇私枉法、權錢交易、違法辦案、執(zhí)法不文明、玩忽職守、執(zhí)法不作為、部門保護、違法干預辦案的崗位、環(huán)節(jié)上,從處理涉訴上訪和申訴案件的教訓等方面入手,大刀闊斧地進行了各項規(guī)章制度的補充、修訂和完善。每年過完春節(jié)后上班的第一個月,我們都將針對上一年執(zhí)行制度方面存在的問題,該明確的明確,該修改的修改,該補充的補充,集中討論、研究制定更加符合實際,更便于操作的規(guī)章制度。目前,經過近三年的不斷補充和完善,我院共制定《獎懲制度》、《考核考評制度》等33項規(guī)章制度,并匯編裝訂,人手一冊。同時,還細化和量化了崗位目標管理責任制,實行了對干警個人的量化百分考核制度,真正形成了比較科學、規(guī)范、嚴密的制度體系,形成了一個靠制度管人,靠制度約束人,各項責任追究到人,各項措施落實到位的良性有序運行機制,以此全方位地管理法院工作,規(guī)范干警行為,使每一位干警都熟悉掌握了本崗位的業(yè)務規(guī)范,明白了“應該做什么,應該怎樣做”的問題。可以說我院目前是機關程序嚴謹,干警守崗敬業(yè),行為規(guī)范、用語文明、態(tài)度熱情,一派井然有序,嚴肅活潑的景象。與此同時,近年來,我院繼續(xù)堅持“兩個務必”和從嚴治院,從嚴治警的方針,狠抓黨風廉政建設工作,向社會公開聘請了10名廉政監(jiān)督員,制定了“黨風廉政建設實施辦法”、“班子成員黨風廉政建設責任措施”,層層簽訂了黨風廉政建設責任書,為審判人員建立了“廉政檔案”、與副科以上干警家屬簽訂了“家庭廉潔承諾書”等,把黨風廉政建設納入隊伍建設責任目標管理,與審判工作同計劃、同部署、同檢查、同考核,并切實實施“警示提醒,誡勉督導,訓誡糾錯”“三項”制度,積極構建健全教育、制度、監(jiān)督并重的懲治和預防腐敗體系,努力構建“不愿為”的自律機制,“不能為”的防范機制,“不敢為”的懲戒機制和“不必為”的保障機制,加強對干警經常性的監(jiān)督與管理,防止和糾正執(zhí)法偏軟不偏寬的現象,將監(jiān)督管理觸角延伸到抓不良傾象,抓苗頭問題上;在每周半日的集體學習中,都要安排全體干警深入學習有關廉潔自律的規(guī)定,以提高干警廉潔自律的自覺性,正因如此,近年來我院沒有發(fā)生過干警違反廉潔自律規(guī)定、違法違紀現象和參與賭博、酗酒等不良社會活動,樹立了人民法院和人民法官良好形象。

樹形象嚴格考核考評工作

為了加強對審判工作考核考評的領導,我院專門成立了考核考評委員會,考核考評委員會主任由院長擔任。其職責一是實施對全院各項制度的執(zhí)行、落實情況檢查、督查;二是負責對全院審、執(zhí)結案件的綜合考評檢查;三是負責對二審改判、發(fā)還案件的考評檢查;四是承擔與審判活動密切相關的如庭審觀摩、裁判文書評比等其他工作任務。為了提高考評辦工作人員的工作積極性,在政治待遇、經濟待遇上給予政策傾斜。

考核考評的組織機構建立健全及考評辦力量充實后,我院針對基層法院特點,及時出臺了“考核考評制度”、“獎懲制度”、“末位淘汰制度”等,細化了審判考核指標?己丝荚u制度中明確了考核考評的任務、職責及工作程序,規(guī)定每

月印發(fā)“考核考評通報”一期,全面詳細通報每一位干警的日常行為規(guī)范及每一案件瑕疵等考評情況,每季召開一次考核考評委員會例會,研究解決考核考評中的有關問題。院內除對刑事、民事、行政、立案、審監(jiān)、執(zhí)行等分類按庭百分制量化考核考評外,還制定“干警個人考核書”,實施了對每一位辦案法官的百分制考核,把辦案任務數、結案率、執(zhí)行率、當庭宣判率、息訴服判率、改判發(fā)還率、上訴維持率、申訴抗訴率、按期審執(zhí)結率、調解率等十多項明確具體的指標任務落實到每一件案件、每一位法官身上,年終考核考評后,超指標者獎,不達指標者罰,對各項考核居于末位的,下崗培訓三個月,培訓經考試合格后,方可重新上崗,不合格者,予以辭退。

考評辦在院考評委員會的直接領導下,雷厲風行地展開了案件評查工作。考評辦五名工作人員中除一名書記員專門負責案卷交、接、轉工作外,其余四人均參與案件考評。考評案件的范圍是各審判業(yè)務庭、執(zhí)行庭審、執(zhí)結的案件,二審維持、改判、發(fā)還的案件,本院提起再審、檢察機關提請抗訴的案件?荚u實行逐案填寫考評表,逐人建立考評檔案,逐月通報考評情況的方法;考評的內容從實體裁判、適用法律、審判執(zhí)行程序到裁判文質量,審、執(zhí)期限、公開審判、當庭宣判及卷宗裝訂等方方面面。考評結果是干警獎勵處罰、提拔使用的重要依據,凡年內出現一件三、四類案件者,除進行經濟處罰、行政處分外,一律不得提拔使用,對考評優(yōu)秀者除給予經濟上的獎勵外,在提拔使用上優(yōu)先考慮。求實效開拓創(chuàng)新抓改革

在強化管理促審判工作中,我院提出了“帶一流隊伍,創(chuàng)一流業(yè)績”的工作口號,要求各部門負責人都要有創(chuàng)新意識,樹立“無功就是過,保守就是錯”的新理念,積極謀求法院的發(fā)展。一是全面推行“三分立”和審判流程管理,實現了從立案、分案、指定承辦人,指定案件審限、結案、執(zhí)行以及審限管理等各個環(huán)節(jié)的電腦網絡化管理,開通了局域網,建立了審務大廳,實行了“窗口式服務”,形成了“大立案、精審判、強執(zhí)行、重監(jiān)督”的運行機制。二是重視合議庭改革,注重強化合議庭職責,放權于合議庭,并對合議庭的組成、職責、審理、評議、裁判、監(jiān)督、考核等作了詳細的規(guī)定,規(guī)范了合議庭制度,提高了審判質量。三是開展證據制度改革,進一步完善和規(guī)范了舉證導引制度,實行證據收據制度,建立健全了當事人申請人民法院調查取證制度,推行舉證時限制度,維護了當事人的合法權益。四是深化庭審方式改革,全面推行了案件的繁簡分流,擴大簡易程序審理范圍,建立了速裁法庭,對事實清楚,證據充分,爭議不大的民事案件和簡單刑事案件,均實行簡易審理,并由專人送達,專人在專門場所審理,當庭宣判或當庭調解,五日內結案,實現快審快結,并本著方便當事人訴訟的原則,對部分基層法庭的管轄范圍進行了調整,以方便群眾,減輕了群眾訴累。同時還專門成立了“基層人民法庭指導領導小組”以加大對基層法庭工作的指導力度,改變過去對基層法庭疏于管理狀況。五是強化法律文書改革。根據市中院《關于全面提高全市法院裁判文書質量的意見》和統一制定的裁判文書寫作規(guī)范格式,我們在裁判文書的改革方面著重加強了證據的分析與認定,注重了文書的論理性,消滅了文書的錯別、漏字現象,以此提高審判的社會效果,樹立司法權威,使裁判文書質量邁上了新臺階。六是進行執(zhí)行工作改革。為了深入貫徹十六大精神,切實解決執(zhí)行難,最大限度地保護當事人的合法權益,維護法律尊嚴,去年以來,我們下大力氣加強執(zhí)行工作,加大執(zhí)行工作的改革力度,嚴格對債權憑證發(fā)放工作的管理,實行執(zhí)行案件的流程管理,對執(zhí)行案件的立案、分案、排期、送達、調查、
